Poland’s e-Invoice System and VAT Updates

Poland’s Ministry of Finance has introduced new regulations for the National e-Invoice System (KSeF), effective July 1, 2024, aiming to encourage early adoption among group companies. Concurrently, amendments to the VAT Act have been endorsed by the Polish President, making e-invoicing via KSeF mandatory from July 1, 2024, for resident businesses and foreign entities with a Polish Fixed Establishment. The FA(2) API test environment has been updated, transitioning to the production version on September 1, 2023, with logical structure details for e-Invoice FA(2) and FA e-Invoice(1). The Polish Sejm has overturned the Senate’s objection, allowing the July 2024 implementation of KSeF B2B e-invoicing. A forthcoming free mobile app will enable real-time e-invoice reporting, mandatory from July 1, 2024, streamlining sales and purchase e-invoices. The March 2023 draft law outlines mandatory e-invoicing in Poland from July 2024, with notable provisions for platform disruptions, penalties, and VAT reforms.
